This is a summary of any current charges or findings under the Criminal Code of Canada or the Health Insurance Act since July 1, 2015, or the Controlled Drugs and Substances Act since May 2018.
Charges – February 18, 2019
(1) That Mr Nero did operate a conveyance while his ability to operate it was Impaired to any degree by alcohol, or a drug, or both contrary to Section 320.14(1)(a) of the Criminal Code.
AND FURTHER:
(2) that Mr Nero, did, within two hours after ceasing to operate a conveyance, have a blood alcohol concentration that was equal to or exceeded 80 mg of alcohol in 100 mL of blood contrary to Section 320.14(1)(b) of the Criminal Code.
AND FURTHER;
(3) that Mr Nero, did, while bound by a Probation Order, fail without reasonable excuse to comply with such order, to wit: keep the peace and be of good behaviour, contrary to Section 733.1(1) of the Criminal Code. (breach of recognizance)
Charges - July 9, 2019
(1) That Mr Nero, did being at large on his recognizance given to a justice and being bound to comply with a condition of that recognizance directed by the said justice fall without lawful excuse to comply with that condition to wit: Do not operate or have care or control of a motor vehicle, contrary to Section 145(3) of the Criminal Code.

On September 28, 2021, the Inquiries, Complaints and Reports Committee (the “Committee”) of the College of Physiotherapists of Ontario (the “College”) made a decision regarding information it obtained about the conduct of Stephen Nero. The Committee identified concerns with S Nero’s conduct related to the following: S Nero’s failure to report to the College, as required, charges/findings under the Criminal Code of Canada (the “Criminal Code”); and S Nero’s understanding of, and demonstrated commitment to, professional ethics.
Because the Committee determined that the concerns about S Nero’s practice are serious and appear to be substantiated by the available evidence, the Committee decided to require that S Nero appear before the Committee to receive a caution regarding the issues of concern.
Since 2017, as required by law, the College has been posting cautions on the public register. A caution is a decision made by the ICRC when a concern raised in a complaint or in a formal investigation is sufficient to require the physiotherapist to attend before a panel of the ICRC to receive feedback from the panel on how to prevent similar concerns from arising in the future. A caution does not involve a finding of wrongdoing, professional misconduct or incompetence and is not disciplinary in nature.

Since 2017, as required by law, the College has been posting information about SCERPs on the public register. A SCERP is ordered by the ICRC when they have identified concerns regarding a physiotherapist’s practice or conduct. A SCERP is an educational program and is not a finding of wrongdoing, professional misconduct or incompetence, nor is it disciplinary in nature.
