On January 31, 2018, the Inquiries, Complaints and Reports Committee (ICRC) identified concerns with Richard MacLean's’ clinical assessment and treatment practices and determined that these concerns were significant enough to require that R. MacLean appear before a panel of the ICRC to be cautioned.

R. MacLean sought a review of the ICRC’s decision by the Health Professions Appeal and Review Board (HPARB). On October 3, 2018, HPARB issued its decision, returning the decision of the ICRC to the College and requesting that the ICRC perform further investigation and reconsider its original decision.

The ICRC met on February 26, 2019 to re-consider this matter. At the conclusion of its deliberations, the ICRC reconfirmed its original decision, requiring R. MacLean to attend before a panel of the ICRC to receive a caution.

Since 2017, as required by law, the College has been posting cautions on the public register. A caution is a decision made by the ICRC when a concern raised in a complaint or in a formal investigation is sufficient to require the physiotherapist to attend before a panel of the ICRC to receive feedback from the panel on how to prevent similar concerns from arising in the future. A caution does not involve a finding of wrongdoing, professional misconduct or incompetence and is not disciplinary in nature.
