On October 10, 2024 the Inquiries, Complaints and Reports Committee (ICRC) referred a matter involving Sujaykumar Kyanahalli Hemachandra to the Discipline Committee for a hearing.  

The dates for the hearing will be posted when they have been confirmed. When the hearing is completed, a summary of the Discipline Committee’s decision will be posted on the Public Register and the decision will be made available on CanLII (www.canlii.org).   

Overview of the Allegations 
  1. At all material times Sujaykumar Kyanahalli Hemachandra (the “Registrant”) was a registrant of the College of Physiotherapists of Ontario holding an Independent Practice certificate of registration and the owner and principal of Dia Physio Care & Wellness Center in Hamilton, Ontario.
  2. In the period of January 1, 2019 to September 19, 2023, the Registrant engaged in professional misconduct within the meaning of the following paragraphs of section 1 of the Professional Misconduct Regulation, O. Reg. 388/08:
    • paragraph 1 (failing to maintain the standards of practice of the profession);
    • paragraph 11 (failing to fulfill an undertaking provided to the College);
    • paragraph 15 (contravening a federal, provincial or territorial law relevant to the member’s suitability to practice); and
    • paragraph 18 (engaging in conduct or performing an act relevant to the practice of the profession that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable or unprofessional).

On June 23, 2022, the Inquiries, Complaints and Reports Committee (“the Committee,” “ICRC”) of the College of Physiotherapists of Ontario (the “College”) considered the information obtained during an investigation into Sujaykumar Kyanahalli Hemachandra’s practice. After reviewing this information, the ICRC identified certain concerns with S Kyanahalli Hemachandra’s practice. Because of these concerns, the ICRC decided to require S Kyanahalli Hemachandra to attend before the ICRC, at a date to be determined by the College, to receive a verbal caution regarding the issues of concern identified during this investigation.

Since 2017, as required by law, the College has been posting cautions on the public register. A caution is a decision made by the ICRC when a concern raised in a complaint or in a formal investigation is sufficient to require the physiotherapist to attend before a panel of the ICRC to receive feedback from the panel on how to prevent similar concerns from arising in the future. A caution does not involve a finding of wrongdoing, professional misconduct or incompetence and is not disciplinary in nature.

On June 23, 2022, the Inquiries, Complaints and Reports Committee (“the Committee,” “ICRC”) of the College of Physiotherapists of Ontario (the “College”) considered the information obtained during an investigation into Sujaykumar Kyanahalli Hemachandra’s practice. After reviewing this information, the ICRC identified certain concerns with S Kyanahalli Hemachandra’s practice. Because of these concerns, the ICRC decided to require S Kyanahalli Hemachandra to complete a Specified Continuing Educational or Remediation Program (SCERP) focused on patient assessments, informed consent, clinical reasoning, performing a controlled act, managing adverse events, record keeping and professional ethics.

Since 2017, as required by law, the College has been posting information about SCERPs on the public register. A SCERP is ordered by the ICRC when they have identified concerns regarding a physiotherapist’s practice or conduct. A SCERP is an educational program and is not a finding of wrongdoing, professional misconduct or incompetence, nor is it disciplinary in nature.
